1. Who you are contracting with
Strive is operated by Caleb Thorburn ("we", "us"). These Terms form a binding agreement between you and us for your use of the Strive website and application (the "Service"). Questions can be sent to strive.futureai@gmail.com.
2. Acceptance
By creating an account, purchasing a subscription, or continuing to use the Service you agree to these Terms. If you are using Strive on behalf of an organisation you confirm you have authority to bind it; if you are using it as an individual you confirm you are of legal age in your country.
3. What the Service provides
Strive provides AI-generated fitness and nutrition guidance, including meal plans, workouts, food logging, physique estimates and simulated future-physique imagery. It is a general wellness product. It is not medical, dietetic or clinical advice, and it does not diagnose, treat or prevent any condition. Always consult a qualified professional before making significant changes to your diet or training, and never disregard professional advice because of something the Service produced.
4. AI outputs, inputs and accuracy
- Outputs are generated by AI models and may be inaccurate, incomplete or unsuitable for you. Verify anything important before acting on it.
- Physique scores, body-fat estimates and future-physique images are approximations and visual illustrations only — they are not measurements, guarantees or predicted results.
- You are responsible for the prompts, photos and data you submit, for having the rights to submit them, and for how you use the outputs.
- You must only upload photos of yourself, and never photos of minors or of anyone who has not consented.
- We may filter, refuse, remove or restrict content and outputs, and may suspend accounts, to enforce these Terms.
- If you believe content on the Service infringes your rights, contact strive.futureai@gmail.com and we will review and remove infringing material. Repeat infringers lose access.
5. Acceptable use
You must not:
- use the Service unlawfully, fraudulently, or to spam or harass others;
- generate or upload illegal, sexual, hateful, deceptive or deepfake content, or content involving minors;
- infringe anyone's intellectual property or privacy rights;
- probe, scrape, reverse engineer, overload, or interfere with the Service or its security, or introduce malware;
- resell, redistribute or share access to paid features, or circumvent usage or plan limits.
5a. Community content: zero tolerance
Clubs, chat and leaderboards are shared with other members. There is no tolerance for objectionable content or abusive users: harassment, hate speech, threats, sexual content, content involving minors, spam, scams, or dangerous health advice are prohibited. You can report any message (Message options → Report) and block any user (Message options → Block user). We review reports within 24 hours, remove offending content, and suspend or terminate the accounts of users who post it. Messages reported by several members are hidden automatically pending review.
6. Your account and content
Keep your credentials confidential; you are responsible for activity under your account. Provide accurate information and keep it current. You retain ownership of the content you submit and grant us a limited licence to host and process it solely to operate and provide the Service to you.
7. Intellectual property
We retain all rights in the Service, including its software, models, prompts, design and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
8. Plans, payment and billing
Strive offers a free tier and a paid Strive+ subscription, billed in advance for each period and renewing automatically until cancelled. The current price is shown before you buy. Access continues until the end of the period you have already paid for.
In the iOS app, Strive+ is sold by Apple as an in-app purchase. Payment is charged to your Apple ID at confirmation of purchase, the subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. Manage or cancel it in your Apple ID subscription settings. Apple's Licensed Application End User License Agreement also applies to the iOS app, and refunds for App Store purchases are handled by Apple.
On the Strive website, our order process is conducted by our online reseller Paddle.com, the Merchant of Record for web orders. Paddle provides customer service inquiries and handles returns for those orders. You can cancel a web subscription from the Billing page. Payment, billing, tax and cancellation mechanics are governed by the Paddle Buyer Terms. Refunds are covered by our Refund Policy.
9. Availability
We aim for a reliable Service but do not guarantee it will be uninterrupted, timely, secure or error-free. Features may change, and third-party AI providers may be unavailable from time to time.
10. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination your licence ends; you may request an export of your data, and we will delete or anonymise it in line with our Privacy Notice.
11. Warranties and liability
To the fullest extent permitted by law the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
12. Indemnity
You will indemnify us against claims arising from your content, your unlawful or infringing use of the Service, or your breach of these Terms.
13. General
These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction. You may not assign your rights without our consent; we may assign in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. If we change these Terms we will update this page and, for material changes, notify you in the app.
